2007 Greater St. Louis Regional Home Energy Efficiency Makeover Contest Rules
Official Rules
1. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW.
2. ELIGIBILITY: To enter the 2007 Greater St. Louis Regional Home Energy Efficiency Makeover Contest, you must be at lest 18 years of age or older, a United States Citizen and a legal resident of Illinois or the AmerenUE territory of Missouri (if AmerenUE is your electricity provider you are in their territory). Each winner must go to Missouri Botanical Gardens’ EarthWays Center, 3617 Grandel Square, St. Louis, MO 63108 to claim his or her prize. In order to claim a prize, the winner must present a current photo ID and written verification of your current address. Condition of eligibility is that all entrants must have a legitimate email address.
3. All employees, officers and directors of the following companies and their affiliates, and the immediate family members or those living in the same household of such employees are not eligible to participate: Missouri Botanical Garden, AmerenUE, Illinois Department of Commerce and Economic Opportunity, Missouri Department of Natural Resources, the St. Louis area Home Performance with ENERGY STAR contractors, and any media outlets used to promote this Contest.
4. By their participation in this Contest, all entrants have agreed to abide by these Official Rules.
5. TO ENTER: Entries will be accepted beginning at 12:01 a.m. on Saturday, September 29, 2007. Participants must enter by going to www.earthwayscenter.org and completing the official entry form in its entirety. Contestants may enter only once per residence. All entries become the property of Sponsor and will not be returned to entrant.
6. All entries must be received by 6:00 p.m. CST on Wednesday, October 24, 2007. Missouri Botanical Garden’s EarthWays Center will provide email verification of receipt of entries. Missouri Botanical Garden and its advertising and promotion agencies are not responsible for lost, late, illegible, incomplete, misdirected or stolen entries or transmissions, or problems of any kind, whether mechanical, human or electronic, that occurs in the submittal of entries. Missouri Botanical Garden is not responsible for technical, telephone, hardware, or software malfunction, or lost, interrupted, incomplete, garbled, or delayed electronic communications, including the inaccurate or incorrect capture of online entry information or any other errors of any kind, however caused, that may occur in the processing of the entries in this Contest.
7. PRIZES: Two prizes will be awarded, one to a legal resident of Illinois and one to a legal resident in the AmerenUE territory of Missouri. The winners will receive a free Energy Efficiency Makeover which will include, at the option of the Sponsor, a Home Performance with ENERGY STAR home efficiency evaluation, home repairs (based on that evaluation and a prioritized repair list), and a post-repair quality assessment – the value of which will not, in any event, exceed $10,000. The selection of the elements of the Home Energy Efficiency Makeover package is at the sole discretion of the Sponsor. Eligible repairs include air sealing; insulation; water heater wrap/replace; CO monitor; smoke detectors; ductwork replace/seal; electrical fixtures/re-wire/light bulbs/seal; exhaust fans; air exchange; HVAC seal/replace/repair; geo-thermal work; fireplaces seal/fire-stop; and windows and doors. With respect to the prizes, no prize substitution, cash redemption, transfer, or assignment of prize is permitted. Missouri Botanical Garden retains the right to award additional prizes of home assessments if funds allow. All Federal, Sate and Local taxes are solely the responsibility of the winner; winners will receive an IRS Form 1099 for the retail value of the prize. All federal, state and local laws and regulations apply.
8. AWARDING OF PRIZES: All prize winners will be selected by a Committee comprised of professionals involved in the Greater St. Louis Regional Home Performance with ENERGY STAR program under the supervision of Missouri Botanical Garden’s EarthWays Center.
Winners are chosen based on the following:
- application information to assess houses that will best demonstrate the benefits of whole house assessments and home energy improvements
- willingness of homeowners to engage in process and need, based on their 250 word paragraph
- opportunity to use up to $10,000 worth of energy improvements, based on what they state their needs are
- opportunity to make a noticeable difference in utility bill amounts, based on an analysis of their utility bills
If necessary, the Committee has the right to call entrants for more information and may make a site visit if needed. All decisions of the Committee, made in their sole discretion, are final and binding in all matters relating to the selection of the winners. Winners will be notified in person by email at the email address provided. The prize announcement will be held on Friday, November 2, 2007 and listed on the website on the same day. Odds of winning depend on number and applicability of eligible entries received. All prizes must be claimed by 5:00 p.m. CST on Friday, November 2, 2007 or will be forfeited. In the case of forfeiture, Missouri Botanical Garden will select another winner on Monday, November 5, 2007, from all remaining eligible entries and this winner will be notified via email – this prize must be claimed by 5:00 p.m. CST on Monday, November 12, 2007.
9. COMPLETION OF WORK: Home assessment and improvement work will be completed as follows:
- Whole house assessments will be done in early November, conducted by contractors in the St. Louis Regional HPwES program
- Report to homeowner and meeting to choose which home improvements the homeowners want done in early November
- Identify subs to participate and complete home improvement work in November
- Post assessment to confirm work done end November, done by contractors and subcontractors of the St. Louis Regional HPwES program
- Improved home announced to media in early December
Sponsor makes no representations or warranties of any kind concerning the appearance or performance of any repairs or enhancements added thereto.
10. GENERAL CONDITIONS: This Contest is governed by the laws of the United States and the States of Missouri and Illinois. VOID WHERE PROHIBITED BY LAW. VOID WHERE RESTRICTED. All prize winners will be required to sign a Declaration of Eligibility and a Liability Release. If a selected winner is ineligible, fails to claim a prize or fails to sign any Declaration of Eligibility and/or Liability Release, the selected winner will forfeit his/her prize and an alternate winner will be selected.
11. DISCLAIMER: By submitting an entry, entrant agrees to release, discharge and hold harmless the Sponsors, subsidiaries, advertising and promotion agencies, internet sites, any print and other media used to promote Contest and all of their respective officers, directors, employees, representatives and agents from and against any and all liability or damages associated with an entrant’s participation in the Contest, including acceptance, use or misuse of the prizes received in this Contest. By entering this Contest, you agree to let the Missouri Botanical Garden’s EarthWays Center access your energy usage records to perform an analysis of your utility bills. By entering this Contest, you consent to the Sponsors’ use of your name, city of residence, photograph, voice and/or likeness, for advertising and/or publicity purposes without additional compensation, except where prohibited by law. By entering this Contest, you also consent to the Sponsors’ use of your house and its photograph and/or likeness for advertising and/or publicity purposes without additional compensation, except where prohibited by law.
12. MISCELLANEOUS: If, in the sole opinion of Sponsor, there is any suspected evidence of tampering or technological corruption or if any portion of the promotion is compromised by virus, bugs works or unauthorized human intervention or any other causes beyond the Sponsor’s control which, in the Sponsor’s sole opinion, corrupts or impairs the administration, security, fairness, or proper play of the Contest, Sponsor reserves the right to terminate or suspend the Contest and select an alternative winner from entries received up to the time of such termination or suspension. Sponsor further reserves the right to disqualify any entrant, who, in its sold judgment, is believed by Sponsor to be tampering with the promotion in any manner whatsoever. Furthermore, Sponsor may amend, suspend, alter or terminate this Contest in any manner at any time without liability of any kind to any person, including without limitation the entrant. Sponsor is not responsible for lost, interrupted, unavailable network, server or other connections, miscommunications, failed phone transmission, cable transmissions, technical failures, garbled or jumbled transmission and the like, internet, network, ISP, website access, availability, or other errors of any kinds whatsoever.
13. MEDIA AND TRAINING SUPPORT: All entrants and winners are required to participate with all media coverage of the contest and winning work. Media sponsors will follow the contest throughout the process. Assessments and work in winning homes may also be used for training purposes for new contractors to the Home Performance with ENERGY STAR program. By entering this Contest you consent to participating fully with all media work and in allowing your home to be used for contractor training purposes.
14. SPONSOR: This Contest is sponsored by Missouri Botanical Garden and its EarthWays Center division, AmerenUE, Illinois Department of Commerce and Economic Opportunity, Missouri Department of Natural Resources and our media sponsors (collectively referred to herein as “Sponsor”). Should the Contest be terminated prior to stated end date, notice will be provided at www.earthwayscenter.org
15. PRIVACY POLICY: Sponsor respects each site entrant’s right to personal privacy. To that end, Sponsor collects and uses information only as disclosed in this Privacy Policy. Personal data collected by sponsor will be used by Sponsor for editorial and feedback purposes, for marketing and promotional purposes, for a statistical analysis of preferences, for product or programming development. Sponsor will use the information to improve its services and better serve its customers. Sponsor may use such information for conducting the activities stated above, for internal marketing and promotional purposes. Sponsor will not sell or give away this information.
